1. Purpose and nature of the service
Gold Silver Global ("the Platform", "GSG") is an international marketplace for coins, bullion, banknotes and medals. It connects private and professional sellers with buyers and offers optional custody, physical verification and escrow services.
GSG acts primarily as an information society intermediary under Directive 2000/31/EC (e-Commerce Directive), the Spanish Law 34/2002 (LSSI-CE), Regulation (EU) 2022/2065 (Digital Services Act, DSA) and, in the US, Section 230 of the Communications Decency Act (47 U.S.C. § 230).
2. Acceptance and capacity
Registration constitutes express acceptance of these Terms and linked policies. Only adults (18+) with full legal capacity may operate. US users must also meet the age requirements of their state of residence.
3. User types
- Individual — occasional buyer/seller, subject to annual limits.
- Professional — operates with CIF/EIN, mandatory e-invoicing, enhanced KYB.
- Internal staff — verifiers, operators and admins.
4. Platform role and intermediary status
GSG is not a party to peer-to-peer sales, except when selling its own pieces or seized items. In custody, it additionally acts as bailee. Intermediary protections apply under Directive 2000/31/EC arts. 12-15, DSA arts. 4-6 and Section 230 CDA, subject to notice-and-takedown obligations for illegal content.
5. Consumer rights
For users in the European Union
Directive 2011/83/EU (Consumer Rights) and Directive (EU) 2019/770 (digital content) apply, transposed in Spain by RDL 1/2007. This includes:
- 14-day right of withdrawal for distance contracts, subject to the legal exceptions for investment goods whose price depends on market fluctuations (gold/silver bullion).
- Minimum 3-year statutory conformity guarantee (Spain, RDL 1/2007).
- Full pre-contractual information before payment.
For users in the United States
Section 5 of the FTC Act (unfair or deceptive practices), state consumer protection laws, and the FTC Mail, Internet, or Telephone Order Merchandise Rule (30-day shipping unless otherwise informed). Sales taxes apply per the nexus established by South Dakota v. Wayfair, Inc. (2018).
6. Fees, prices and taxes
- Default sales commission: 5% of sale price, borne by the seller.
- Shipping insurance and custody: configurable and shown before payment.
- Minimum value per item: 20 EUR / equivalent USD.
- EU VAT: charged per the professional seller's regime and the buyer's country (margin scheme where applicable).
- US sales tax: GSG collects and remits sales tax in states where it has nexus under Wayfair.
7. Custody, escrow and dispute lock
Payment is held by the Platform until the buyer confirms acceptance or the claim window expires. Opening a dispute automatically locks escrow release. This is the marketplace's core safeguard and admits no exception.
8. Prohibited items and geoblocking
The Prohibited and restricted items policy applies in full. Country restrictions respect Regulation (EU) 2018/302 (geoblocking) except where a restriction is justified by international sanctions, OFAC lists or cultural heritage rules.
9. User-to-user communication
All communication occurs within the Platform. Exchanging external contact data (phone, email, social media, IBAN, Bizum, or links) is prohibited.
10. User content and notice-and-takedown
GSG is a hosting provider. The notice-and-action procedure of DSA art. 16 and LSSI-CE art. 17 applies. In the US, GSG processes good-faith notices under Section 230 CDA and the DMCA when copyright is concerned.
11. Suspension and termination
GSG may suspend or close accounts for fraud, KYC non-compliance, prohibited items, off-platform communication attempts or any conduct compromising the marketplace.
12. Limitation of liability
Save for willful misconduct or gross negligence, GSG's liability is limited to the transaction value at issue, net of fees. For EU consumers, mandatory rights under RDL 1/2007 are not limited. For US consumers, implied warranties that state law makes non-waivable are not limited.
13. Arbitration and class-action waiver — pending legal validation
This clause is pending review by counsel. Enforceability of mandatory arbitration and class-action waivers varies by US state and is generally unenforceable against EU/Spanish consumers.
For US users, unresolved disputes may be submitted to binding arbitration before the American Arbitration Association (AAA) under its consumer rules, seated in [state: pending]. The parties waive class participation. This clause does not apply to EU/Spanish users; individual right of action is preserved.
14. Governing law and jurisdiction
For users resident in the EU/Spain, mandatory consumer rights of the country of residence prevail. Disputes may be brought before the consumer's local courts or the EU ODR platform (https://ec.europa.eu/consumers/odr).
For users resident in the US, applicable federal law and the law of [state: pending] govern. Disputes are submitted to courts or arbitration per clause 13, to the extent enforceable.
15. Changes
GSG may update these Terms; changes are notified by email at least 14 days in advance to EU users and in line with DSA art. 14 and Regulation (EU) 2019/1150 (P2B) for professionals.
