Prohibited and restricted items

Items that cannot be listed on GSG and restrictions from international sanctions (OFAC, EU), AML and specific regulations.

Data controller and service operator:

1. Legal framework

  • Law 10/2010 (Spain) and RD 304/2014 — AML.
  • Directive (EU) 2015/849 and (EU) 2018/843 — 4th and 5th AMLD.
  • Bank Secrecy Act (31 U.S.C. § 5311 et seq.) and USA PATRIOT Act.
  • OFAC — US sanctions programs.
  • EU sanctions — Council Regulations in force.
  • DSA arts. 9 and 16 — orders to act and notice of illegal content.

2. Absolutely prohibited

  • Coins or bullion from illegal activities.
  • Replicas, modern reproductions or counterfeits sold as originals.
  • Cultural or archaeological items without a valid export permit (see Archaeological coins).
  • Items under international embargo or on OFAC / EU sanctions lists.
  • Stolen items or listed in Interpol Stolen Works of Art.
  • Material inciting hate, violence or discrimination.
  • Numismatic items including human remains without authorization (relevant for NAGPRA in the US).

3. Restricted (additional documentation required)

  • State commemorative coins with export limitations.
  • Bullion above certain weights under national rules.
  • Items pending slabbing/grading (must be disclosed).
  • Operations with counterparties from FATF high-risk jurisdictions — require EDD (Enhanced Due Diligence).

4. Sanctions screening

GSG screens against:

  • OFAC SDN and sectoral lists.
  • Consolidated EU and UN lists.
  • Spanish SEPBLAC list.

Positive matches block the operation and trigger reporting where required.

5. Moderation

Each listing passes an AI review and, depending on score, a human review before publication. Initial acceptance is not exonerating: GSG may remove a listing at any time (DSA art. 16) on new information.

6. Consequences

  • Immediate listing removal.
  • Payment and escrow lock.
  • Possible account block or closure (DSA art. 23).
  • Reporting to authorities where applicable (SEPBLAC, FinCEN SAR).

7. Notice and right to appeal

We notify the user with clear reasons per DSA art. 17. The user may appeal via internal channels (see Dispute Policy) and via ODR/ADR or judicial routes.
