Custody Policy

How optional custody at GSG headquarters works under the Spanish commercial deposit framework and the US UCC Article 7.

Data controller and service operator:

1. Legal framework

  • Spanish Civil Code arts. 1758-1789 — deposit.
  • Spanish Commercial Code arts. 303-310 — commercial deposit.
  • Uniform Commercial Code (UCC) Article 7 — Documents of Title, warehouse receipts (US).
  • EU AMLDs and US BSA — AML diligence applicable to custodians.

2. Legal nature

GSG custody is a paid commercial deposit (Spain/EU) and functions as bailment for hire / warehousing under UCC Art. 7 in the US. GSG is bailee and issues a digital entry/exit record.

3. Modes

  • Mode A — direct seller-to-buyer shipment with mandatory packing and unboxing videos. GSG custody not involved.
  • Mode B — seller → GSG → buyer, verification, custody and final shipment. Included for Premium; flat fee otherwise.

4. Insurance

Every item in custody is insured to the value declared in the listing. The buyer may add insurance for the final shipping leg.

5. Entry verification

  • Weight/diameter/photo/video check.
  • Comparison with the published listing.
  • Verifier-signed report.

6. Exit from custody

  • Sale and shipment to buyer.
  • Return to seller if listing fails verification.
  • Court order or valid administrative requirement.
  • Seller withdrawal before sale (handling fee applies).

7. Bailee liability

For users in Spain / EU

GSG is liable for willful misconduct or negligence under Civil Code arts. 1766-1769. Insurance covers declared value.

For users in the United States

Under UCC § 7-204, the bailee is liable for damages caused by failure to exercise reasonable care. Document-based liability limitations apply only within UCC bounds.
